April 22, President Trump signed an Executive Order (EO) suspending the entry for 60 days of a very narrow class of individuals who are outside of the U.S. who have not yet been issued an immigrant visa which is a path to obtaining green card while outside of the U.S.
The EO does not address nonimmigrant visas. There are no changes for H-1B, L, TN or E-3 visa holders, as well as business visitors and tourists.
PERM labor certification and adjustment of status (green card) applications while in the U.S. are also not affected. This EO will have no impact on the U.S. business immigration sponsorship activities or the status of their foreign national employees who work in the U.S.
However, the proclamation requires that within 30 days of the effective date, the Secretaries of Labor and DHS, in consultation with the Secretary of State, shall review nonimmigrant programs and recommend to the President other appropriate measures to stimulate the U.S. economy and ensure “the prioritization, hiring and employment” of U.S. workers. This could lead to restrictions on the nonimmigrant visa programs and we will monitor this unfolding situation closely and advise our clients of any subsequent developments.
